In 2004, Jerry Almeida, then the fundraising director of Action Aid India, was shocked to discover an office in the garage of their Bangalore headquarters, where some of the staff were penning letters in a child's scrawl. The letters were sent out to individual donors all over the world, allegedly written by the Indian children people were paying to sponsor. The forgeries were far from the personalized interaction that the charity led the sponsors to believe.
The transgression is not a lonely instance of unscrupulousness in India's sprawling non-profit sector. With 3.3 million registered non-governmental organizations (NGOs), India's sprawling non-profit sector raises between $8 and $16 billion in funding every year. According to Home Ministry statistics, foreign funding to Indian NGOs saw a 56% increase between the fiscal years 2005-2006 and 2006-2007. In 2008, the latest available data, the total official foreign aid to India was $2.1 billion. But according to NGO watchdogs, almost half of that money is misused, mostly to support high administrative costs of running the organization. "NGOs who raise Indian donations are accountable to the Indian public, but foreign donors are abroad and there is no accountability. They receive a letter and they are happy that they are helping some Indian child," says Mathew Cherian, chairperson of the NGO watchdog Credibility Alliance. "There are many NGOs who won't even show you their accounts."


NGO accountability - or the lack of it - is, of course, not India's problem alone. A 2008 assessment of 30 of the world's most powerful global organizations cites transparency as one of the least developed dimensions of accountability. In India, the problem is compounded by the highly unorganized nature of the NGO sector; organizations are often required to register under multiple laws without any uniform accounting policy or reporting framework. It's a problem driven both at the organizational and the donor level. Says Almeida: "Money is important for development but most people get swayed by emotional provocation and pay money to NGOs indiscriminately." (See pictures of the making of modern India.)
One of the key complaints against Indian non-profits is their over-spending on overheads. A 2006-07 government report on utilization of foreign funds by Indian NGOs shows that out of the $2.15 billion in foreign aid received, around $680 million was used for organizational expenses, compared to $563 million used for relief and rehabilitation of victims of natural calamities, $435 million for rural development, $269 million for construction and maintenance of schools and colleges and $263 million for welfare of children. "Every organization has legitimate administrative costs," says Thomas Chandy, CEO of Save the Children, India, which spends around 14% of its funds on administration. "It is impossible to distinguish administrative costs from program costs because it's all set up for delivering programs." Instead of focusing on how money gets allocated, Chandy says, "We should look at the impact created at ground level."

But there are other uncomfortable questions that also call the credibility of a lot of Indian NGOs into question. Chief among them is businesses using NGOs for money laundering. India's federal investigation agency (CBI) is currently looking into money laundering and fund misappropriation charges against one of the country's most prominent human rights activist, Ravi Nair. Nair and his NGO, the South Asia Human Rights Documentation Centre, were indicted by the European anti-fraud agency in October last year, though Nair has denied all wrongdoing. While groups like Credibility Alliance, iCongo and Give India are working toward increasing NGO accountability through annual reviews and accreditation, they still have a long way to go. Despite being around for many years, these watchdogs are used only by a few hundred NGOs. Credibility Alliance, for example, has only 600 members. Even international organizations like the Humanitarian Accountability Project (HAP), an international agency that seeks voluntary system of accountability for 40,000 international NGOs, only has 36 members globally. The SociÉtÉ GÉnÉrale de Surveillance (SGS), the world's leading for-profit inspection, verification, testing and certification company has certified only 68 of the world's approximately 10 million NGOs. USAID-funded Foreign AID Ratings has certified three. 

Foreign aid to India has come under the microscope by foreign donors over the last few years, with those critics arguing that India - with a defense budget of $31.5 billion, a substantial foreign aid program of its own and an U.S.-endorsed claim to a permanent Security Council seat - should be able to fund its own development. Today India is still home to 42% of the global population living on less than $1.25 a day, but if the World Bank's forecast that poverty in India will fall by more than a third by 2015, the government needs to take a closer look at better use of its foreign aid.


In response to these complaints, the federal government has been tightening its grip. Delhi has banned 41 NGOs from receiving foreign funding in the past few years, and in August, the government revised the Foreign Contributions Regulation Act (FCRA), a 1976 law that overees NGOs that receive foreign funding. Under the Act, organizations have to submit an annual report to the government giving details of the funds received and their utilization. In 2008, out of the 34,803 registered associations, only 18,796 filed their reports. Now, with this year's revisions, NGOs that do not file returns to the Home Ministry will lose the right to receive foreign funds for three years, which will, in many cases, effectively suspend their operations. India's latest five-year plan also advocates a single comprehensive law with a single set of accountability procedures to encourage accountability and transparency within the NGO sector. After all, as Chandy says, NGOs are in the "credibility market" and they cannot afford to be above accountability.

ROME (AFP) – Italy was on tenterhooks Tuesday as beleaguered Italian Prime Minister Silvio Berlusconi faced a crucial confidence vote in parliament that could bring down his government.
Following a split between Berlusconi's ruling coalition and rebel deputies led by ex-ally Gianfranco Fini in July, the prime minister faces confidence motions in the upper and lower houses of parliament.
He appealed to Fini's supporters on Monday to vote for him, calling on them to show "responsibility" and saying: "Our internal divisions... are not at all insurmountable. We must unite for the good of Italy."
He asked his former partners not to "betray the mandate from our voters."
The 74-year-old also argued that a vote of no-confidence would be damaging for Italy given the current turbulence on eurozone financial markets.
He warned against the "political folly" of ousting him at such a time.
While Berlusconi has a safe majority in the Senate, he has been weakened by a string of sex and corruption scandals in recent years and his support in the Chamber of Deputies is less sure.
The result of the vote in the Chamber is expected at around 1300 GMT.
Anti-Berlusconi protesters are also planning to hold a series of rallies in central Rome to demand a change of government.
A protest by the main opposition Democratic Party on Saturday in the Italian capital drew tens of thousands of people.
"It's really too close to call," James Walston, professor of politics at the American University in Rome, said ahead of the vote.
"There have been desperate negotiations going on, because Berlusconi cannot afford not to be prime minister. He needs the protection it gives him from his current and possibly upcoming prosecutions," he added.
Should he lose either vote, Berlusconi will be forced to offer his resignation to President Giorgio Napolitano, who will then decide whether an alternative centre-right majority can be formed.
If such a transition government is not feasible, Napolitano would have to dissolve parliament and call early elections.
Berlusconi on Monday also appealed to the opposition Union of the Centre (UDC) party -- but the party said the prime minister first had to resign before talks on any new alliance could begin.
"If Berlusconi believes in uniting the moderates, he should resign before the confidence vote," UDC party leader Pier Ferdinando Casini said.
"He always thinks that everyone else is at fault," he added.
Over the last week, the government has lobbied wavering lawmakers intensively in the hope of persuading them to return to the fold.
Analysts are predicting a result as close as 314 votes for the government against 313 for the opposition.
If Berlusconi wins with such a tiny majority, Italy may have to go to elections before the government's mandate runs out in 2013 in order to prevent a paralysis of parliament.

SYDNEY (AFP) – A controversial commodities tax that helped topple former Australian leader Kevin Rudd appeared in trouble Tuesday, with miner Xstrata accusing the government of backtracking on a key element.
Anger over the so-called "super profits tax" and Rudd's damaging war of words with the mining sector, the country's biggest export earner, triggered a slump in his popularity which led to his shock axing in a June party coup.
His successor, Julia Gillard, called a truce with heavyweight miners Xstrata, BHP Billiton and Rio Tinto by watering down the tax so that it applied only to coal and iron-ore profits and was levied at 30 rather than 40 percent.
But the compromise looks in danger of unravelling, with Swiss-based Xstrata telling a government committee that Canberra was reneging on a promise to refund state-based royalties payments in exchange for the tax.
"For us the word or the statement 'all royalties' is very clear -- we wouldn't have signed the agreement had we thought it was ambiguous," Xstrata coal chief Peter Freyberg told a senate hearing.
Freyberg said the refunding of royalties had been a key condition of the miners' deal with Gillard, yet the government could not guarantee that this would still be the case if the royalties increased in the future.
"Given that this was an increase in tax, we needed certainty of the future, and hence argued for the point of all royalties being credited," he said.
BHP and Rio have raised similar objections, earlier telling the committee they would have been reluctant to sign off on the tax if they thought there were question marks over the payment of royalties.
Ending the mining industry's vocal campaign against the super tax was critical to Gillard's bid for re-election in September, and she faces a battle to get the levy approved by independent MPs key to her minority coalition rule.
The Organisation for Economic Cooperation and Development last month urged Canberra to make the tax more closely resemble Rudd's original plan, arguing that the compromise deal was too low and not broad enough.
But Treasurer Wayne Swan has ruled out making further changes and said the ruling Labor party will "fight for this in the parliament because it's good for the economy".

NEW YORK – The game show "Jeopardy" will pit man versus machine this winter in a competition that will show how successful scientists are in creating a computer that can mimic human intelligence.
Two of the venerable game show's most successful champions — Ken Jennings and Brad Rutter — will play two games against "Watson," a computer program developed by IBM's artificial intelligence team. The matches will be spread over three days that will air Feb. 14-16, the game show said on Tuesday.
The competition is reminiscent of when IBM developed a chess-playing computer to compete against chess champion Garry Kasparov in 1997.
The "Jeopardy" answer-and-question format is a different kind of challenge. It often requires contestants to deal with subtleties, puns and riddles and come up with answers fast.
"Watson" is named for IBM founder Thomas J. Watson. It will look nothing like the computer "maid" on "The Jetsons." Rather, IBM said its on-screen appearance will be represented by a round avatar.
The computer has already been tested in some 50 games against past "Jeopardy" champions. But neither IBM nor "Jeopardy" representatives would say what "Watson's" record was.
The winner gets a $1 million prize. IBM said it would donate its winnings to charity, while Jennings and Rutter said they would give half of their prize money away.
Jennings had the game show's longest winning streak, taking 74 games in a row during the 2004-2005 season. Rutter has won more money than any other "Jeopardy" player, nearly $3.3 million during his original appearance and three subsequent tournaments.
IBM is hoping the technology it exhibits will have some practical uses eventually, for instance helping doctors diagnose illnesses or solving customer problems at technical support centers.

New York – For writer-director John Wells, the premiere of "The Company Men" marks a serious job shift. The man known for creating, writing and directing hit television shows including "E.R." and "Third Watch" has made the leap to the big screen with his drama about corporate downsizing and its effect on the lives of a group of men whose jobs go down the drain. His fame as a creative force got him a dream cast, with Oscar-winning actors Tommy Lee Jones, Kevin Costner and Chris Cooper joining Ben Affleck as the guys finding out the hard way what it is like to be unemployed.
Affleck joined Wells at the Paris Theatre in midtown Manhattan on Wednesday, Dec. 8, to celebrate the premiere, but it was earlier, at the Toronto Film Festival screening, that the actor discussed the film at a press conference. The married father of two explained that he tapped into his own life experience to get into the mindset of his character, a hotshot executive who suddenly finds himself adrift, which naturally affects his marriage and family life.
"I think it would be really hard for me to play somebody who was in a real marriage," he said, "without having one and being in one and understanding that and being able to bring that to bear or at least in a real relationship. When I was younger and not understanding what that was about, it would've been hard for me to understand the pressures, the complications, the nuances of the whole thing."
Playing a corporate guy was actually more of a stretch for Affleck, but not knowing where the next job is coming from is something he's very familiar with experiencing.
"Being an actor, you have one audition, you might get that part and then the job's over and you have no guarantee that you'll ever work again for the rest of your life. So that's really scary. One thing about working in the arts is that you internalize that reality and you learn it from a very early age," he said. "That's a fact that people who work in much more traditional corporate jobs are now learning, and it isn't easy."

MANCHESTER, England (AFP) – South Korea's Park Ji-Sung scored the goal that put Manchester United on top of the Premier League table after a 1-0 win over Arsenal, leaving manager Alex Ferguson with mixed emotions.
While delighted by Park's agile 41st minute header at Old Trafford that saw United climb to the summit, Ferguson was frustrated by the midfielder's impending absence on international duty.
Park is set to link up with South Korea for the Asian Cup, which takes place in Qatar from January 7-29, and Ferguson was left ruing his departure at a key stage of the season.
"He's in fantastic form and we lose him after December 26 for the Asia Cup for seven matches, which is disappointing," said Ferguson.
United's win over Arsenal means they will go to champions Chelsea, now three points adrift, on Sunday with confidence sky high.
Victory at Stamford Bridge will ensure they spend Christmas Day at the top of the table for the first time since 2006.
And a win on Sunday would an ideal way for Ferguson, who will then have been in charge for 24 years, one month and 14 days to mark his achievement in surpassing fellow Scot Sir Matt Busby as United's longest-serving manager.
"We had to play well against Arsenal and we wanted to perform and we did in the first-half," Ferguson said. "We played very, very well.
"I don?t think it was a feisty game, also the referee was lenient in the first half and in the second-half he showed yellow cards at the right time.
"You have to expect the two top teams to compete like that."
He added: "You have to play well and we have been playing well. Today (Monday) was another good performance. Arsenal came back in the second half and pegged us back but we had some good chances on the counter-attack."
Arsenal, who were top before the game, trail United by two points having, like title rivals Manchester City, also on 32 points, played a game more.
But manager Arsene Wenger is refusing to press the panic button and insists the title is still a realistic target for his side, searching for their first major trophy since the 2005 FA Cup.
"It's a big frustration, a big disappointment," he said. "What's important is that we bounce back in the next game against Stoke on Saturday.
"After what I've seen tonight, there's no reason not to believe," the Frenchman insisted.
"How do I feel? What I feel doesn't matter, we lost the game. The game was very intense and I think Manchester United defended very well."
Wenger criticised the Old Trafford playing surface, saying: "The pitch was very poor in my opinion and both sides suffered because of it.
"They (United) made technical mistakes as well because of the pitch. The pitch not good enough to play good football."
However, Wenger cautioned against making too much out of one result.
"You have to be calm and realistic. You do not necessarily have to jump to big conclusions."

BALTIMORE, Maryland (AFP) – Koji Uehara, a 35-year-old Japanese right-handed closing relief pitcher, has agreed to a one-year Major League Baseball deal worth three million dollars to stay with Baltimore.
Uehara, the first Japanese player in the Orioles' history, was a starter last year but found greater success as a closing late in this past season, going 1-2 with 13 saves and a 2.86 earned-run average.
Uehara, whose contract gives the club an option on him for the 2012 season, led the American League last year with 11 strikeouts for every walk he issued.
In 55 games with the Orioles, Uehara has a 3-6 record with a 3.58 earned-run average.
Baltimore went 66-96 last season, second-worst to Seattle in the American League and last in the AL East division.
The Orioles have not reached the playoffs since 1997 and have made the playoffs only twice since winning the 1983 World Series.

MONTREAL – Welterweight champion Georges St-Pierre outpointed trash-talking Josh Koscheck on Saturday night at UFC 124, winning 50-45 on all three judges' cards in front of a UFC-record 23,152 fans at Bell Centre.
The 29-year-old Montrealer (21-2) carved up Koscheck's face with his jab and punished his legs with kicks in his fifth successful title defense.
"I didn't reach my goal tonight. My goal was to take him out, but he was very tough," St-Pierre said.

CLEVELAND – Boxing promoter Don King was stopped by security at Cleveland's Hopkins International Airport for having ammunition in his carry-on luggage.
Hopkins Airport spokeswoman Jacqueline Mayo says the 79-year-old King was stopped by members of the Transportation Safety Administration on Sunday night. She says King had ammunition for .38-caliber and .357-caliber firearms in his bag.
Mayo says the ammunition was taken and that King was released to continue his trip, she believes to Florida. She said she didn't know if King received a citation.
King didn't immediately return a telephone message seeking comment.
WOIO-TV in Cleveland first reported the incident and said King was in Cleveland for his wife's funeral.
Eighty-seven-year-old Henrietta King died Thursday in Florida from complications from stomach cancer.
